GENERAL TERMS AND CONDITIONS
Please read this section carefully. It sets out your agreement with us and contains important terms designed to protect your interests, and to aid you in understanding how your agreement with us works.
Terms
1.0.0 The “us” or “we” or “our” refers to Bike Bus.
1.1.0 The “you” or “your” refers to those named on the Reservation Form.
Your Agreement with Us
2.0.0 Your agreement with us begins when you confirm your reservation or when you sign the declaration contract presented to you at the start of your rental period.
2.1.0 Your agreement with us ends when you have returned all the equipment hired and settled all debts to Bike Bus.
2.2.0Bike Bus is a French Registered Company (RCS BERGERC 44117186500047) and our Terms and Conditions are governed by French Law.
Our Responsibility
3.0.0 We promise to supply you with equipment in accordance with the reservation contract and of a quality and condition suited to the purpose intended and as advertised on our promotional media.
3.1.0 If we are hiring equipment out to you then subject to these terms and conditions and your reservation contract, we accept responsibility should you or any member of your party suffer personal injury, illness, loss, damage, or death as a direct result of any failure to perform, or improper performance of any part of this equipment, our services, and by any of our suppliers of services (providing they were at the time carrying out work authorized by us).
3.2.0 We are not liable where any failure to perform or improper performance was due to :
3.2.1 Force majeure
3.2.2 The acts/omissions of the person affected
3.2.3 The acts/omissions of a third party not connected with our agreement
3.2.4 Events which we could not have foreseen or avoided even with all due care and attention.
3.2.5 It is a condition of your acceptance of our claim of responsibility, that you notify us of any claim that you or any member of your party has with us, and that you provide us and our insurers with any assistance we may reasonably require.
Your Responsibility
4.4.0 Outdoor activities can be hazardous if you behave foolishly, so don’t take risks. In the interest of safety, you undertake to follow our advice and that of our suppliers, to comply with any local codes of conduct, to adhere to the countryside code and to act sensibly and prudently at all times.
4.5.0 It is your responsibility to properly insure yourself and all members of your party for the activities which you will undertake to do during your time with Bike Bus. We do not offer alternative personal insurances.
4.6.0 We expect you to have consideration for others. If in our opinion, or in the opinion of any other person in authority, you or any member of your party behaves in such as way as to cause or to be likely to cause danger, annoyance or distress to any third party, or damage to property, then we are entitled, without prior notice, to terminate our contract with you.
If this is the case:
4.6.1 You will be required to return all equipment hired immediately.
4.6.2 You must settle any outstanding debts concerned with your agreement with Bike Bus.
4.6.3 You must settle any debts concerning damage, injury or loss caused by you or any member of your party, to anything or anyone connected or not with our agreement.
4.6.4 We will have no further responsibility toward you
4.6.5 No refunds shall be made for any reason
4.6.6 Expenses or costs incurred as a result of termination are all payable by you.
Bicycle Quality and Conformity
5.0.0 Every bike is checked before each rental and re-checked on its return to make sure that it is in top condition for the customer. You can watch the Bike Bus representative perform each check if you wish, and please feel free to ask any questions, we are always happy to share our knowledge with you.
5.1.0 Before each rental the following 9 checks are performed with the customer present :
5.1.1 Verify the condition of the saddle and the tightness of the seat clamp and the general condition of the frame and components.
5.1.2 Verify the indexing of the rear gears and the correct positioning of the rear derailleur hangar and the derailleur itself (tighten the lock bolt).
5.1.3 Verify the condition of the chain, condition of the rear tire, trueness of the wheel, condition of the spokes, and check for play in the rear axle.
5.1.4 Verify the indexing of the front gears, the position of the front derailleur.
5.1.5 Verify the action of the rear brakes – balanced spring action, enough wear left on the pads and whether they hit the rim in the middle and flat, the condition of the tire near the rim, smooth cable action and outer cable routed correctly, brake lever secure on the handlebars, tourist adjusters un-deployed, and 1cm of brake lever movement to action the brakes.
5.1.6 Spin the front wheel and check for trueness, condition of the front tire, condition of the spokes, and check for play in the front axle.
5.1.7 Verify the action of the front brakes – balanced spring action, enough wear left on the pads and whether they hit the rim in the middle and flat, the condition of the tire near the rim, smooth cable action and outer cable routed correctly, brake lever secure on the handlebars, tourist adjusters un- deployed, and 1cm of brake lever movement to action the brakes.
5.1.8 Check tire pressures and pump up if required.
5.1.9 Verify the handle bars are straight and secure, the front and rear wheels are secure onto the frame.
5.2.0 The bike can now be fitted to the customer in terms of saddle height, handlebar height (only available on some bikes), and pedal type.
5.3.0 After each rental the following 4 checks are performed with the customer present :
5.3.1 All the bike components are intact and positioned correctly
5.3.2 The tyres are still inflated enough for storage
5.3.3 Verify any apparent damage to the frame and/or components
5.3.4 All the accessories have been returned in good condition (Clause 8)
The Declaration Contract
6.0.0 The Declaration contract is signed by you on delivery and this, with your reservation contract and these terms and conditions, form all the details of your agreement with us. It is your responsibility to check these conditions, your reservation contract, and the declaration contract, and advise us of any inaccuracies before signing your acceptance of them.
6.0.1 Upon release of equipment to you for hire, we will verify together its condition and you will be required to sign the Declaration Contract thus accepting responsibility for the items hired in the condition given.
6.0.2 The Hire Declaration reads: “I am happy that the equipment supplied is in good condition and of a suitable size and quality. I agree that for the hiring period I am responsible for the return in reasonable condition of all goods hired. I sign in accordance with this for myself and on behalf of my group. I am at least eighteen years of age.”
6.0.3 If you leave without returning the bikes and/or return them with unreasonable damage to them, Penalty Fees corresponding to the whole or part value of the equipment hired will become due. (Clause 8)
6.0.4 You accept responsibility for any deterioration, injury or loss caused by you or not by you, to anything or to anyone connected with our agreement, during the rental period.
The Security Deposit
7.0.0 We want to protect our bikes from being damaged and to continue renting excellent quality bikes. So if they get damaged, they need to be repaired with the right parts and by a skilled bike mechanic. To cover the cost these repairs, we ask you for a Security Deposit. This will include :
7.0.1 A pre-authorization from a credit card for the replacement value for all bikes and equipment rented. This either involves blocking money on your account using the TPE credit card machine or noting your credit card details on the Declaration Contract for later use should it be required.
7.0.2 A copy of your Passport or Drivers licence or Personal Identification Card
7.0.3 Your signature on the Declaration Contract. Once signed, you are responsible for all equipment hired to you.
7.1.0 Once you have returned all equipment hired and it has been verified that it is in reasonable condition, the pre-authorization will be cancelled and/or your credit card details that have been noted down by us, will be removed from the declaration contract and returned to you.
7.2.0 Should you return any/all of the equipment hired in an unreasonable condition, either caused by you or not caused by you, penalty fees will become due.
7.5.1 What constitutes ‘unreasonable condition’ is left to the discretion of Bike Bus and/or its representatives. Bike Bus’s decision is fair but final. The deterioration of the bikes condition or loss of the bike or components may not have been caused by you, but whilst the equipment is in your care, it remains your responsibility.
7.5.2 If the equipment quality has deteriorated whilst under your responsibility, a Bike Bus representative will inform you of the corresponding Penalty Fee(s) that is(are) due.
Penalty Fees
8.0.0 When all your hired equipment has been returned to Bike Bus, its condition will be assessed be a Bike Bus representative. This will reveal either no damage and/or reasonable wear and tear, or unreasonable damage categorized as structural and/or surface damage.
8.1.0 There are no penalty fees for no damage or reasonable wear and tear.
8.2.0 Unreasonable structural damage means an item has been rendered unusable and will have to be replaced. The penalty fee is 25 euros plus the full replacement cost of the item, be that of a single component or of the whole bike.
8.3.0 Unreasonable surface damage means that the item has sustained damage which will reduce the resale value of the item. The penalty fee is 25 euros plus the depreciation value relative to the damage caused.
8.4.0 Penalty fees for unreasonable damage will be payable at the time of returning the equipment hired or withdrawn from your card already given as security along with any fees demanded by the bank for such a transaction.
Roadside Assistance
9.0.0 When you call us for Roadside Assistance, each individual case being different, we will either spend time talking you through a simple fix over the phone, or we will travel out to you to fix or replace your bike(s). Upon arriving at your bike, we will assess its condition together with you, fix or replace, and then recheck the bike’s condition making sure it is now safe to ride. Labor and replacement parts may be free of charge for this service, and our travel expenses will be left to the discretion of Bike Bus.
Other
10.0.0 These Terms and Conditions may be altered at any time.
SPECIFIC CONDITIONS FOR RESERVATIONS MADE BY EMAIL
Confirming your Reservation
11.0.0 You can now reserve your bikes and pay online at www.bike-bus.com. Whilst the online payment facility is not linked to any reservation software with live stock availability, any bikes and/or accessories that you have reserved online might not be available.
11.0.1 If the bikes ordered are not available, I will inform you within 24hrs of your booking and offer you a change of dates, and/or a change of bikes, or a full refund.
11.0.2 The online payment service is not linked to reservation software, so it is not possible for the system to check availability of your choice of bikes, and so Article 13.4.0 does not apply.
11.1.0 To confirm your reservation, Bike Bus must receive full payment (or an amount agree upon) before the start of your reservation. You can pay the full amount (or an amount agreed upon) using our online bike reservation and payment platform, or by bank transfer or by sending a cheque (in euros).
11.1.1 If your payment doesn’t reach our bank account before midnight of the day before the start date, your reservation will not be confirmed and will be cancelled. You may still be able to get bikes but only on a first come, first served basis and at onsite prices.
11.1.2 Once you have confirmed, you will be sent an email of confirmation with your updated contract. No need for you to print the contract out, we will have one at the delivery for you to sign. Please bring your Identity Card with you
11.1.3 Groups and tour operators may confirm their reservation without making the confirmation payment. Bike Bus must receive written confirmation before the start date by email or mail.
Alterations to your Reservation
12.0.0 Alterations made by you to your reservation contract before confirmation carry no charge.
12.1.0 Each alteration made by you to your reservation contract after confirmation may carry a charge of 30 Euros, at the discretion of Bike Bus. The balance of payments will be due at the start of your holiday.
Cancellation of your Reservation
13.0.0 For cancellations made by you before confirmation, no money is due to Bike Bus.
13.0.1 For cancellations made by you after confirmation, an administration fee of 30% shall be retained by Bike Bus. If the client paid more than 30% on confirmation, the remaining amount shall be refunded back to the client by the same means that it was paid
13.0.2 For cancellations made by a group or tour operator after their written confirmation, where total payment was deferred to a later date, the total amount of the reservation becomes due within 15 days of the cancellation.
13.0.4 Your ability to cancel your reservation after confirmation with a percentage refund, is not a ‘right’ in French Law, as stated in the articles L.121-21 to L.121-21-8 of the French ‘Code de la Consomation’. It is only the generous allowance and discretion of Bike Bus.
13.3.0 If YOU have to cancel your reservation during your rental period, the full reservation fee is retained by Bike Bus. Any amount owing is due before your departure. If this amount is not forthcoming, you will be contacted at a later date by Bike Bus and/or a debt recovery company.
13.4.0 If WE have to cancel your reservation after confirmation and before the start date and time, you will be contacted and given choice of a change of date or equipment, or cancellation with full refund plus 30% penalty fee in your favour. This is the law of reciprocity, penalties for all.
Payment on Delivery
14.0.0 The remainder of the reservation cost is due at the start of your rental period, or
14.1.1 The remainder can be deferred to the end of the hire period at the discretion of Bike Bus, or
14.1.2 The remainder can be deferred for up to 30 days at the discretion of Bike Bus.
Late payment
15.0.3 When an additional payment period has been agreed upon by the two parties and shown on the invoice, the payment shall be made no later than the agreed payment period (Article L. 441-6, para. amended law of May 15, 2001).
15.0.4 If the deferred payment is not received on time, Bike Bus may reissue the invoice with all discounts and degressive prices removed. Late payment will also incur late payment penalties at a rate of 10% of the total invoice per month of delay (Article 53 NRE), as well as a fixed fee of € 40 (Article D441-5 NRE) in recovery charges.
The Declaration Contract
16.0.0 The Declaration contract is signed by you on delivery and/or your reservation contract and these terms and conditions, form all the details of your agreement with us. It is your responsibility to check these conditions, your reservation contract and/or the declaration contract, and advise us of any inaccuracies before signing your acceptance of them.
16.0.1 Upon release of equipment to you for hire, we will verify together its condition and you will be required to sign the contract thus accepting responsibility for the items hired in the condition given.
16.0.2 If you leave without returning the bikes and/or return them with unreasonable damage to them, Penalty Fees corresponding to the whole or part value of the equipment hired will become due. (Clause 8)
16.0.3 You accept responsibility for any deterioration, injury or loss caused by you or not by you, to anything or to anyone connected with our agreement, during the rental period.
Other
17.0.0 These Terms and Conditions may be altered at any time.
